Terms & Conditions
Effective October 31, 2026 · Last updated October 2026
The Learners Pathway ("TLP," "we," "our," or "us") provides live, online educational programs, digital courses, assessments, parent guidance, and learning resources. We operate entirely online. By enrolling in any program, booking an assessment, registering for a class, purchasing a course, accessing materials, or using any TLP service, you confirm that you have read, understood, and agreed to these Terms. They apply to parents, guardians, students, and anyone using TLP programs, platforms, resources, or services.
1. Our Program Philosophy
The Learners Pathway is not a drop-in tutoring service. Our programs are structured learning pathways that build writing, reading, communication, and thinking skills over a committed term, in live, small, ability-based cohorts. Families should enroll when they are ready to follow the program schedule and expectations.
2. Enrollment Agreement
Enrollment is a commitment to a structured program for its stated term. By enrolling, the parent or guardian agrees to these Terms on behalf of themselves and their student.
3. Program Commitment and Seat Reservation
Cohorts are small and capped. Enrollment reserves a seat for your student for the committed term. Because seats are limited, commitments and notice periods are taken seriously (see Cancellation and Withdrawal).
4. Program Terms, Duration, and Start Date
Each program has a stated duration and start date, shared at enrollment. Programs run on a set schedule in live online classes.
5. Payment Terms
Program fees are billed as stated for the selected program (for example, monthly tuition across a committed term). Fees, schedule, and billing cycle are presented at enrollment. Tuition reflects a committed term; it is a feature of the program, not a subscription to cancel at will.
6. Charter and Homeschool Families
TLP is an approved vendor with several California charter schools, including Heartland Charter School, Visions In Education, and Creekside Charter School, and families may be able to use charter instructional or enrichment funds toward our programs.
-
How payment works: By default, where a family uses charter funds, the charter school pays TLP from the student's instructional funds (typically by purchase order or vendor invoice). A family may also choose to pay out of pocket, and a family remains responsible for any fees not covered by their charter, including when charter funds are unavailable, not yet approved, exhausted, or declined. The parent or guardian who enrolls is ultimately responsible for payment of fees for the committed term.
-
Approval and the charter agreement: Enrollment using charter funds is subject to the charter's approval of TLP as a vendor, approval of the program by the student's assigned teacher where required, and the family's own agreement with their charter. A charter brings TLP in only when a family requests it.
-
Records: To meet vendor and funding requirements, TLP may share enrollment, attendance, and progress information with the family's charter, limited to what is needed for compliance (see Privacy Policy).
-
Parent participation: Parent participation in program activities is welcome but optional and is not required.
7. Cancellation, Withdrawal, and Program Discontinuation
TLP programs are structured learning commitments. If a parent wishes to discontinue enrollment, written notice must be provided to TLP by email or the approved parent communication method, and a minimum of 30 days' written notice is required before the end of the current committed term or before any renewal period. Early withdrawal does not automatically cancel remaining payments for the committed term; payments due under the selected commitment remain payable unless TLP approves an exception in writing or cancellation is required by applicable law. TLP may consider exceptions at its discretion; exceptions are not guaranteed and may require supporting documentation.
8. Refund Policy
Program fees, assessment fees, registration fees, digital course fees, and resource fees are non-refundable once assessment, onboarding, course access, program access, or instruction has begun, except where a refund is required by applicable law. No refunds are issued for missed classes, student absence, illness, travel, scheduling conflicts, device or internet issues, change of mind, lack of participation, incomplete assignments, non-use of access, or voluntary withdrawal after a program begins. Nothing in this section limits any refund right you may have under California law.
9. Missed Classes and Makeup Policy
Live classes run on a set schedule. Makeups are not guaranteed and are offered at TLP's discretion where feasible. Missed classes are not refunded or credited.
10. Online Program Requirements
Programs are delivered online. Families are responsible for a reliable internet connection, a suitable device, and a quiet space for live classes.
11. Assessments, Parent Meetings, and Recommendations
Assessments and parent meetings help us place students by ability and recommend the right program. Recommendations are educational guidance, not guarantees of a specific outcome.
12. Parent Responsibility and Home Support
Parents support attendance, a suitable learning environment, and timely communication. Day-to-day parent participation in class activities is optional.
13. Student Conduct
Students are expected to participate respectfully in live classes. TLP may address disruptive conduct, including removal from a class or program in serious cases, to protect the learning environment for the cohort.
14. Online Course and Digital Resource Access
Access to courses and digital resources is for the enrolled student and family only and may not be shared, resold, or distributed.
15. Intellectual Property
All TLP curriculum, materials, assessments, and content are the property of The Learners Pathway and are protected by law. They may be used only for the enrolled student's learning and may not be copied, shared, or redistributed.
16. Recordings and Class Content
Classes or portions of classes may be recorded for educational and quality purposes. Recordings and class content are TLP property and are handled consistent with our Privacy Policy.
17. Results Disclaimer
We are committed to strong teaching, but educational outcomes depend on many factors. TLP does not guarantee specific grades, scores, or results.
18. Program, Schedule, and Instructor Changes
TLP may adjust schedules, instructors, or program details when needed and will communicate material changes to families.
19. Scheduled Breaks
Programs follow a schedule that may include scheduled breaks, shared with families in advance.
20. Chargebacks and Payment Disputes
Please contact us first to resolve any billing concern. Chargebacks filed without contacting us may result in suspension of access pending resolution.
21. Media Consent
Media consent is optional and collected separately. With permission, TLP may use student photos, videos, audio, testimonials, writing samples, or project work for educational and promotional purposes. Families may decline or withdraw media consent at any time.
22. Communication
By enrolling, families agree to receive program-related communication by email, text, or the approved parent communication method. Families may opt out of non-essential messages.
23. Limitation of Liability
To the fullest extent permitted by law, TLP's liability arising from its programs or services is limited to the fees paid for the program at issue. TLP is not liable for indirect or consequential damages.
24. Changes to Programs, Policies, and Terms
TLP may update programs, policies, and these Terms. The updated version will be posted with a new date. Continued use after changes are posted means the family accepts the updated Terms, unless otherwise required by law.
25. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from enrollment, program participation, payments, digital course access, or use of TLP services is subject to the jurisdiction of the state and federal courts located in California, to the fullest extent permitted by law.
